By visiting the website, viewing a report, submitting a form, joining the beta program, or otherwise using Boom Stalker, you agree to these Terms and acknowledge the Privacy Policy and Educational Disclaimer.
If you do not agree to these Terms, do not use the website or submit information through it.
2. Eligibility
You must be legally capable of agreeing to these Terms.
You must be at least 18 years old to apply for the Boom Stalker beta program, register for restricted features, or consent to marketing email or SMS communications.

- Immediate access
- Continued access
- A particular feature
- A specific launch date
- Free or paid access in the future
- That submitted suggestions will be implemented
Beta features may contain defects, interruptions, inaccurate information, incomplete functionality, or unexpected behavior.
We may limit, suspend, change, or end beta participation at any time.
Users participate voluntarily and at their own risk.
10. Feedback and Submissions
You may voluntarily submit feedback, suggestions, comments, questions, error reports, or other ideas regarding Boom Stalker.
You retain ownership of original content that you submit.
By submitting feedback about Boom Stalker, you grant Zapf Technologies LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable, and perpetual right to use, reproduce, modify, incorporate, publish, and develop that feedback for business, product-development, research, and promotional purposes without compensation or attribution.
Do not submit confidential, proprietary, illegal, or third-party information that you are not authorized to share.
11. Acceptable Use
You agree not to:
- Use Boom Stalker for unlawful, fraudulent, or abusive purposes
- Attempt to gain unauthorized access to the website, systems, reports, forms, accounts, or data
- Introduce malware, harmful code, automated attacks, or disruptive technology
- Scrape, harvest, copy, or systematically extract website content or data without written permission
- Reverse engineer or attempt to discover protected source code, scoring logic, software, or security controls
- Impersonate another person or misrepresent your identity
- Submit false contact or consent information
- Interfere with another person’s use of the website
- Remove copyright, trademark, disclaimer, or ownership notices

The Boom Stalker name, logo, website design, written content, report formats, software, code, databases, scoring frameworks, graphics, and original materials are owned by or licensed to Zapf Technologies LLC and are protected by applicable intellectual-property laws.
Subject to these Terms, users receive a limited, revocable, non-exclusive, non-transferable right to view publicly available Boom Stalker content for personal, non-commercial research and educational use.
You may share a direct link to a public Boom Stalker webpage or report.
You may not reproduce, sell, license, modify, create derivative commercial products from, or redistribute substantial portions of Boom Stalker content without prior written permission.
13. Third-Party Services and Links
Boom Stalker may use or link to third-party platforms, market-data providers, hosting services, communication services, reports, websites, software, or tools.
Third-party services are governed by their own terms, privacy policies, availability, and security practices.

Users are responsible for providing a valid mobile number that they are authorized to use.
Mobile carriers are not responsible for delayed or undelivered messages.
Boom Stalker may suspend or discontinue SMS communications at any time.
16. Website Availability and Changes
We may modify, update, restrict, suspend, or discontinue any part of Boom Stalker at any time without guaranteeing advance notice.
We do not guarantee that the website, forms, reports, beta features, links, or communications will always be available, uninterrupted, secure, or error-free.
Maintenance, outages, internet failures, provider interruptions, market-data failures, or other events may affect availability.
17. Disclaimer of Warranties
To the fullest extent permitted by law, Boom Stalker and all related content, reports, tools, beta features, and communications are provided “as is” and “as available.”
Zapf Technologies LLC disclaims all express and implied warranties, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that Boom Stalker will meet a user’s expectations or produce any particular financial, trading, research, or business outcome.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to every user.
18. Limitation of Liability
To the fullest extent permitted by law, Zapf Technologies LLC and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to Boom Stalker.
This includes, without limitation:
- Trading or investment losses
- Lost profits
- Lost opportunities
- Lost data
- Business interruption
- Reliance on inaccurate or delayed information
- Unauthorized access
- Third-party conduct
- Website or communication failures
To the fullest extent permitted by law, the total liability of Zapf Technologies LLC for any claim relating to Boom Stalker will not exceed the greater of:
- The amount the user paid directly to Zapf Technologies LLC for the specific service giving rise to the claim during the previous six months; or
- One hundred U.S. dollars ($100)
Some jurisdictions do not permit certain liability limitations, so portions of this section may not apply to every user.
19. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Zapf Technologies LLC and its owners, officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from:
- Your misuse of Boom Stalker
- Your violation of these Terms
- Your violation of applicable law
- Your infringement of another person’s rights
- Information or content you submit
- Trading or investment decisions made by you or on your behalf
20. Suspension and Termination
We may suspend or terminate access to Boom Stalker, a beta program, a form, a communication channel, or another feature when we reasonably believe a user has:
- Violated these Terms
- Misused the website
- Created security or legal risk
- Submitted false information
- Interfered with the service or another user
- Engaged in fraudulent or abusive conduct
Sections that by their nature should continue after termination will survive, including intellectual-property, disclaimer, liability, indemnification, and governing-law provisions.
21. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where applicable law requires otherwise.
22. Changes to These Terms
We may update these Terms as Boom Stalker’s website, features, business model, technology, or legal obligations change.
Updated Terms will be posted on this page with a revised “Last updated” date.
Continued use of Boom Stalker after updated Terms become effective means the revised Terms apply to future use.
23. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
24. Entire Agreement
These Terms, together with the Privacy Policy and Educational Disclaimer, form the agreement between you and Zapf Technologies LLC regarding use of Boom Stalker, except where a separate written agreement applies.
